Customised Orders Terms and Conditions
1. About Us
MBS Workwear and Embroidery (“we”, “us”, “our”) specialise in the supply of workwear, PPE,
and the customisation of garments through printing and embroidery. By placing an order with
us, you agree to the following Terms and Conditions.
2. Orders and Supply of Garments
We supply garments from a combination of in-store stock and third-party suppliers.
Items not held in our regular stock may be ordered specifically from our suppliers to
fulfill a customer request.
Any item ordered in specifically at the customer’s request is considered a special order.
3. Returns, Cancellations and Restocking Fees
3.1 Stock Items:
Uncustomised stock items may be returned in line with statutory consumer rights,
provided they are unused and in a resalable condition.
3.2 Special Order Items:
Items ordered in specifically from suppliers are non-returnable unless faulty.
Where a supplier agrees to accept a return, the customer will be responsible for:
Any supplier restocking fee charged to us
All return postage and associated costs
3.3 Customised Items:
Customised garments (printed or embroidered) are non-refundable and non-returnable,
unless faulty or incorrect due to our error.
4. Customisation Process and Customer Approval
We provide digital visuals/mock-ups for all customised orders prior to production.
It is the customer’s responsibility to check and approve:
Design layout and positioning
Spelling and wording
Colours and sizes
Production will only begin once written approval has been received.
Once approval is given, no changes can be made and we accept no liability for errors
approved by the customer.
5. Colour Accuracy
If a specific colour is required, the customer must supply the relevant Pantone, HEX or
equivalent colour reference at the time of artwork approval.
If no colour code is provided, colours will be selected using the eyedropper tool within
our design software, sampling colours directly from the artwork or image supplied by
the customer.
Please note:
Colours may vary slightly between screen display and the final printed or
embroidered product due to differences in screens, materials and production
processes.
Minor colour variations do not constitute a fault.
6. Positioning and Tolerance
We aim to position all customisation as accurately as possible.
Due to garment construction and production methods, a tolerance of approximately
1.5–2cm is considered acceptable for placement (e.g. centre chest, left breast, sleeve).
Any placement within this tolerance is not considered a misprint or mis-embroidery and
will not be eligible for replacement or refund.
7. Errors, Faults and Liability
7.1 Our Stock:
If an error occurs during customisation due to our machinery or process on garments
supplied by us, we will replace the item with the same or equivalent garment where
reasonably possible.
7.2 Customer-Supplied Items:
Garments supplied by the customer are accepted at the customer’s own risk.
While we take every care during customisation, we cannot guarantee outcomes on
customer-supplied items.
In the event of machine error, damage or failure during customisation of customer-
supplied garments, MBS Workwear and Embroidery accepts no liability for
replacement or compensation.
All customised garments are non-refundable, even if produced correctly and in
accordance with the approved artwork.
8. Customer-Supplied Artwork and Intellectual Property
The customer confirms they have the legal right to use any logos, designs or artwork
supplied.
We accept no responsibility for copyright, trademark or intellectual property
infringement arising from customer-supplied artwork.
9. Turnaround Times
Turnaround times provided are estimates only and may vary due to stock availability,
supplier delays or workload.
We are not liable for losses arising from delays outside of our reasonable control.
10. PPE Disclaimer
PPE items are supplied in accordance with manufacturer specifications.
It is the customer’s responsibility to ensure selected PPE is suitable for its intended use
and meets any relevant industry or site-specific requirements.
11. Limitation of Liability
Our liability is limited to the value of the goods supplied.
We shall not be liable for indirect, consequential or financial losses including loss of
profit or business.
12. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales.
